General Terms and Conditions

1. Scope and provider

These terms apply to all contracts concluded through artofwalks.com between Arthur Frank, Hans-Sachs-Straße 12, 14471 Potsdam, Germany ("ArtOfWalks", "we") and you as the customer. Full provider details are in the legal notice.

2. Services

We produce short video clips and walkthrough videos from photographs that you supply. The scope of each package — number of clips, runtime, delivery time, revision rounds — is the one described on the package you buy at the moment of purchase.

3. How a contract is concluded

The packages presented on this website are an invitation to order, not a binding offer. By completing checkout you make a binding offer. The contract comes into effect when we confirm your order by email or begin production, whichever happens first.

4. Prices and payment

All prices shown are total prices in euro. What you see is what you pay; no further charges are added at checkout.

Payment is due in full at checkout. Payment is processed by Stripe Payments Europe Ltd. We accept the methods offered in the Stripe checkout, such as card, Apple Pay and Google Pay. We do not receive or store your card details.

5. What we need from you

After payment you send us the photos you want us to work with, by email. Production starts when your material arrives, and the delivery times stated in your package are counted from that moment, not from checkout.

By sending us material you confirm that you hold the necessary rights to it and that we may use it to produce your video. If a third party asserts claims against us because material you supplied infringed their rights, you will indemnify us against those claims, unless you are not responsible for the infringement.

6. Delivery

We deliver the finished video as a digital file by email or download link. Delivery times are: single clips 3 business days, 5 clip pack 5 business days, 10 clip pack 7 business days, full walkthrough 5 business days. If we cannot meet a deadline we will tell you before it passes.

7. Revisions

The Full Walkthrough package includes one revision round. Further revisions, and revisions to other packages, can be agreed separately against payment.

8. Rights of use

On full payment you receive a permanent, worldwide, non-exclusive right to use the delivered video for any purpose, including advertising your property on Airbnb, Booking.com, VRBO, social media and your own website. Background music we add is licensed for that use.

We reserve the right to show the finished video as a reference on our own website and social media channels. If you do not want that, tell us and we will not do it — before or after delivery, no reason needed.

9. Money-back guarantee

In addition to your statutory rights we grant you a voluntary money-back guarantee: if you are not satisfied with the delivered video, tell us within 14 days of delivery and we will refund the full purchase price. This guarantee is granted freely and does not limit any of your statutory rights, in particular your right of withdrawal below and your rights in case of defects.

10. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. In cases of slight negligence we are liable only for breach of an essential contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and in that case only for the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

11. Applicable law and dispute resolution

German law applies. If you are a consumer with your habitual residence in another EU country, this does not deprive you of the protection of the mandatory provisions of the law of that country.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

Right of Withdrawal for Consumers

If you are a consumer — that is, you are entering into this contract for purposes that are predominantly outside your trade, business or profession — you have the following right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us — Arthur Frank, Hans-Sachs-Straße 12, 14471 Potsdam, Germany, artofwalks@gmail.com, phone +49 172 5360412 — of your decision to withdraw from this contract by a clear statement, for example a letter sent by post or an email. You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

Your right of withdrawal expires in the case of a contract for the supply of services if we have fully performed the service and only started performance after you gave your express consent and at the same time confirmed your awareness that you would lose your right of withdrawal upon complete performance of the contract.

In practice this means: we do not start producing your video before the 14 days have passed, unless you ask us to start earlier. If you want your video faster — and most customers do — simply say so when you send your photos. We will then confirm in writing what that means for your right of withdrawal. Your money-back guarantee under clause 9 applies either way.
